NAVER VIETNAM RECRUITMENT PRIVACY POLICY

In this Personal Data Protection Policy (“Policy”), NAVER Vietnam Company Limited (NAVER Vietnam) may be the Personal Data Controller, the Personal Data Controller and Processor, and/or the Third Party involved in personal data processing, depending on the context and specific case when NAVER Vietnam processes personal data.

Privacy Policy Contents

Article 1

Interpretation of Terms
    • 1. Personal Data: Digital data or information in other forms that identifies or helps identify a specific person. Personal data includes basic personal data and sensitive personal data. Personal data, once de-identified, is no longer personal data.
    • a. Basic personal data includes:
    • • Surname, middle name, and birth name; other names (if any);
    • • Date, month, year of birth; date, month, year of death or disappearance;
    • • Gender;
    • • Place of birth, place of birth registration, permanent residence, temporary residence, current residence, hometown, contact address;
    • • Nationality;
    • • Personal image;
    • • Phone number, citizen identity card number, identity card number, personal identification number, passport number, driver's license number, vehicle license plate number;
    • • Marital status;
    • • Information about family relationships (parents, children, spouse);
    • • Information about an individual's digital account;
    • • Other information associated with a specific person or helping identify a specific person not falling under point b of this Clause.
    • b. Sensitive personal data: Personal data associated with an individual's privacy which, if violated, will directly affect the legal rights and interests of agencies, organizations, and individuals. Sensitive personal data includes:
    • • Data revealing racial origin or ethnic origin;
    • • Political views, religious views, and beliefs;
    • • Information about private life, personal secrets, and family secrets;
    • • Health status;
    • • Biometric data, genetic characteristics;
    • • Data revealing an individual's sexual life and sexual orientation;
    • • Data on crimes and violations of law collected and stored by law enforcement agencies;
    • • An individual's location determined through positioning services;
    • • Login usernames and passwords for accessing the individual's electronic identification accounts; images of the citizen identity card, citizen identification document, and people's identity card;
    • • Login usernames and passwords for bank accounts; bank card information; bank account transaction history data; financial and credit information and data on the activities and transaction history in finance, securities, and insurance of customers at credit institutions, foreign bank branches, payment intermediary service providers, securities firms, insurance companies, and other permitted organizations;
    • • Data tracking behavior and usage of telecommunications services, social networks, online media services, and other services in cyberspace;
    • • Other personal data prescribed by law as requiring confidentiality or strict security measures.
    • 2. Personal Data Protection: Activities of preventing, detecting, stopping, and handling violations related to personal data in accordance with the law.
    • 3. Data Subject: An individual reflected by personal data.
    • 4. Processing of Personal Data: One or more activities affecting personal data, such as: collecting, recording, analyzing, confirming, storing, editing, disclosing, combining, accessing, retrieving, recovering, encrypting, decrypting, copying, sharing, transmitting, providing, transferring, deleting, destroying personal data, or other related actions.
    • 5. Consent of the Data Subject: A clear, voluntary expression affirming the data subject's permission to process their personal data, except as otherwise provided by law.
    • 6. Personal Data Controller: The party that decides the purposes and means of personal data processing. Under this Policy, the Personal Data Controller is NAVER Vietnam; NAVER Vietnam does not authorize any Third Party to perform the role of Personal Data Controller.
    • 7. Personal Data Controller and Processor: The party that simultaneously decides the purposes and means of processing and directly processes personal data.
    • 8. Personal Data Processor: The party that performs personal data processing on behalf of the Personal Data Controller or the Personal Data Controller and Processor through a contract.
    • 9. Third Party: Organizations or individuals other than the Data Subject, Personal Data Controller, Personal Data Controller and Processor, and Personal Data Processor who are permitted to process personal data in accordance with the law. At NAVER Vietnam, a Third Party is a party that signs a contract/agreement with the Data Processor without signing a direct contract/agreement with NAVER Vietnam.
    • 10. De-identification of Personal Data: The process of altering or removing information to create new data that cannot identify or help identify a specific person.
    • 11. Personal Data Processing Impact Assessment: The analysis and evaluation of risks that may arise during personal data processing in order to apply risk mitigation measures and protect personal data.
    • 12. Personal Data Protection Unit at NAVER Vietnam: The Data Protection Board assigned to perform Personal Data Processing activities at NAVER Vietnam.

Article 2

General Provisions
    • 2.1. Personal data provided by the Data Subject to NAVER Vietnam and/or obtained by NAVER Vietnam through other actions is understood to include Basic Personal Data and/or Sensitive Personal Data of the Data Subject and individuals related to the Data Subject.
    • 2.2. The Data Subject has notified and obtained consent from individuals related to the Data Subject regarding compliance with this Policy when providing their personal data (including but not limited to dependents, related persons as prescribed by law, representatives, guardians, friends, references, beneficiaries, authorized persons, partners, emergency contacts, etc.) to NAVER Vietnam, and shall be responsible if consent from these groups has not been obtained.
    • 2.3. The Data Subject has read, researched, and fully understood their rights and obligations, the types of Personal Data being processed, the purpose of processing, and the organizations and individuals permitted to process personal data. The information stated in this Policy is equivalent to a notice from NAVER Vietnam to the Data Subject before NAVER Vietnam proceeds with personal data processing. For the processing of sensitive personal data, NAVER Vietnam will notify the Data Subject via email/written document that the data to be processed constitutes sensitive personal data.
    • 2.4. From the time the Data Subject provides personal data to NAVER Vietnam and/or NAVER Vietnam obtains it through other actions until the Data Subject no longer has any transactions/obligations at NAVER Vietnam, or according to NAVER Vietnam's decision (whichever occurs later), NAVER Vietnam is permitted to process the Data Subject's personal data for the following purposes in ways NAVER Vietnam deems necessary and not contrary to applicable law:
      1. Contacting for confirmation, updating information, and supporting candidates in taking assessments and performing subsequent steps in the recruitment process.
      2. Updating Employee information in NAVER Vietnam's HR and Compensation & Benefits (C&B) systems; performing employer obligations for new employees including but not limited to: recording employee codes, levels, positions, salaries, and allowances (if any); opening bank accounts for employees where necessary; procedures with social insurance and tax authorities and other competent state agencies in Vietnam upon request; and purchasing health insurance for employees (if applicable).
      3. Performing NAVER Vietnam's rights and obligations under contracts/agreements with Vendors, partners, and in accordance with legal regulations.
      4. Entering/storing/retaining collected information in NAVER Vietnam's software and technology systems for the purpose of: post-recruitment information transfer, performing contractual services including but not limited to: answering queries, resolving incidents, and fulfilling requests from competent state agencies during inspections.
      5. Organizing training and evaluating work performance as agreed upon between the Data Subject and NAVER Vietnam.
      6. Supporting and ensuring the Data Subject can exercise their rights in accordance with the law.
      7. Storing personal data in the systems of storage service providers.
      8. Checking, testing, installing, managing, upgrading, and improving technical aspects and personnel responsible for security systems to protect Data Subject information.
      9. Promoting, introducing, and informing the Data Subject about services, recruitment programs, research, surveys, news, updates, events, contests with prizes, and event programs
      10. Contacting, evaluating, and processing requests from the Data Subject, including responding to queries or feedback, resolving or investigating any complaints, legal requests, or disputes, or exchanging information and providing documents or other related materials as requested by the Data Subject.
      11. Implementing measures to ensure the safety, security, and protection of Data Subject data against harm or risks of harm; serving storage, management, protection, and information security purposes.
      12. Resolving disputes, complaints, and denunciations.
      13. Providing and exchanging information with competent state agencies, organizations, and other individuals in accordance with applicable law.
      14. Performing promotional advertising for surveys and contests organized or co-organized by NAVER Vietnam.
      15. Other purposes as assessed by NAVER Vietnam from time to time, and will be publicly announced upon any change.
    • 2.5. The Data Subject confirms, agrees, and commits that:
      1. The Data Subject has been notified by NAVER Vietnam about personal data processing through this Data Protection Policy and agrees to NAVER Vietnam's collection and processing of personal data from the time the Data Subject confirms Consent via website/App/Email/Chat or signs written/electronic consent with NAVER Vietnam, until the processing purposes stated in section 2.4 have been fulfilled. Withdrawal of consent (if any) shall not affect the legality of personal data processing previously agreed upon by the Data Subject. The Data Subject is fully aware of and accepts responsibility for all consequences or damages that may occur or arise from their withdrawal of consent without notice from NAVER Vietnam. If the withdrawal of consent is not performed in accordance with applicable law and adversely affects personal data processing, NAVER Vietnam may apply necessary measures to protect its legal rights and interests in accordance with applicable law and/or the commitments/agreements of the Data Subject with NAVER Vietnam.
      2. If the Data Subject withdraws consent, NAVER Vietnam may proactively contact and request the Data Processor/Third Party to stop processing the Data Subject's personal data at any time deemed appropriate, subject to applicable procedures and the technical infrastructure capacity of NAVER Vietnam and/or the Data Processor and/or the Third Party from time to time. If the withdrawal of consent is not performed in accordance with applicable law, or due to technical or infrastructure constraints, NAVER Vietnam is exempt from all obligations and responsibilities related to such withdrawal request.
      3. The Data Subject shall notify and update NAVER Vietnam of all changes related to their personal data and agrees that NAVER Vietnam has the full right to update and edit the Data Subject's personal data in accordance with such change notifications.
      4. NAVER Vietnam has the right to manage and retain all personal data obtained in the manner and for the duration it deems appropriate to fulfill the processing purposes stated in Article 2.4. The Data Subject has the right to access, view, rectify, and withdraw their request in writing using the form issued by NAVER Vietnam under the Personal Data Protection Regulations. NAVER Vietnam has the right to refuse requests to view, edit, or delete Personal Data if deemed inconsistent with applicable law, including the grounds specified in Article 19 of the Law on Personal Data Protection No. 91/2025/QH15.
      5. Where NAVER Vietnam agrees to edit the Data Subject's personal data, it will do so subject to applicable procedures and technical infrastructure capabilities. If editing cannot be performed due to technical factors or infrastructure limitations, NAVER Vietnam will notify the Data Subject via email/written document within 72 hours of receiving the request and is simultaneously exempt from all related obligations and responsibilities.
      6. NAVER Vietnam agrees to delete personal data in the following circumstances:
        (i) The Data Subject finds the data no longer necessary for the agreed collection purpose, and accepts and assumes responsibility for any damages that may arise from the deletion request;
        (ii) The Data Subject withdraws consent;
        (iii) The Data Subject objects to NAVER Vietnam's processing with justifiable and reasonable grounds within NAVER Vietnam's capacity to accommodate;
        (iv) The Data Subject identifies and proves that their personal data has been processed for purposes inconsistent with those agreed upon, or that the processing constitutes a violation of applicable law.
        Upon accepting a deletion request, NAVER Vietnam will proceed to delete the Data Subject's personal data within 72 hours based on technical infrastructure capabilities, unless otherwise required by law, and shall perform an irreversible deletion to the extent possible where data was processed for unauthorized purposes or where the agreed processing purposes have been fulfilled.
      7. The Data Subject acknowledges that, although NAVER Vietnam has implemented appropriate technical and organizational security measures, risks of incidents affecting personal data may still occur due to objective causes beyond NAVER Vietnam's reasonable control. In such cases, NAVER Vietnam shall fulfill its incident notification obligations in accordance with applicable law, including notification to affected data subjects within a reasonable timeframe in accordance with applicable law, and cooperate in remedying the consequences to the extent of its capacity. The Data Subject agrees not to hold NAVER Vietnam liable for damages arising from incidents beyond NAVER Vietnam's reasonable control.
      8. For the processing of personal data of a person declared missing or deceased, NAVER Vietnam must obtain consent from the spouse or adult children of such person; if unavailable, consent from the parents of the missing/deceased person is required, except as otherwise prescribed by applicable law.
      9. For the processing of children's personal data, consent from the child (if aged 7 or older) and the consent of the parent or legal guardian is required, except as otherwise prescribed by applicable law. Data Subjects providing personal data of a child data subject warrant that they have obtained the required consent and are responsible if consent has not been obtained. Prior to processing children's personal data, NAVER Vietnam will verify the child's age and request consent from (i) the child aged 7 or older; and (ii) the child's parent or legal guardian as prescribed by law.
      10. Other organizations/individuals that may act as Personal Data Processors or Third Parties provided with the Data Subject's personal data by NAVER Vietnam include but are not limited to:
        (i) Partners and organizations providing products and services to the Data Subject upon request;
        (ii) Organizations/individuals provided with data for other purposes as assessed by NAVER Vietnam from time to time.
      11. To agree that, for the purpose of processing the Data Subject's personal data, NAVER Vietnam may provide/share the Data Subject's personal data with other related organizations/individuals of the Company within or outside the territory of Vietnam, (including: (1) NAVER Cloud Corporation - NCC, South Korea, operating NAVER Works; (2) NAVER Corporation, South Korea, managing the group's internal systems). Transfers of personal data outside Vietnam are carried out in accordance with applicable personal data protection law. NAVER Vietnam enters into binding data processing agreements with the recipients and fulfills applicable legal procedures as required by law.

Article 3

Rights and Obligations of Data Subjects
  • 3.1. Data Subjects have the following rights:

    Rights of the Data Subject

    1. Right to be Informed: The Data Subject has the right to be informed about the processing activities involving their personal data, except as otherwise provided by law.
    2. Right to Consent or Withhold Consent, and Right to Request Withdrawal of Consent: The Data Subject has the right to consent to or withhold consent for, and to request the withdrawal of consent for, the processing of their personal data, except as provided under Article 19 of the Law on Personal Data Protection.
      Upon receipt of a duly submitted request to withdraw consent, restrict processing, or object to the processing of personal data, NAVER Vietnam must respond within two (02) working days, provide the data subject with full information on the procedure for ceasing personal data processing, and implement such cessation within fifteen (15) days, except where processing does not require the data subject's consent as provided under Article 19 of the Law on Personal Data Protection. Where it is necessary to request the Data Processor or Third Party to cease processing, this shall be implemented within twenty (20) days.
      Depending on the nature and complexity of the request, the processing period may be extended no more than once, by no more than fifteen (15) days, with NAVER Vietnam notifying the data subject of the reason and bearing the burden of demonstrating that the extension is necessary and reasonable.
    3. Right to Access, Rectify, or Request Rectification of Data: The Data Subject has the right to access, rectify, or request rectification of their personal data as provided under Clause d, Point 2.5, Article 2 of this Policy, except as otherwise provided by law.
      Upon receipt of a duly submitted request to access, rectify, or request rectification of personal data, NAVER Vietnam must respond within two (02) working days, provide the data subject with full information on the applicable procedure, and implement such actions within ten (10) days. Where it is necessary to request the Data Processor or Third Party to rectify the data subject's personal data, this shall be implemented within fifteen (15) days.
      Depending on the nature and complexity of the request, the processing period may be extended no more than once, by no more than ten (10) days, with NAVER Vietnam notifying the data subject of the reason and bearing the burden of demonstrating that the extension is necessary and reasonable.
    4. Right to Request Provision, Deletion, or Restriction of Processing of Personal Data; Right to Object to Processing: The Data Subject has the right to request provision, deletion, or restriction of processing of their personal data, and to submit a request to object to the processing of their personal data, except as otherwise provided by law.
      Upon receipt of a duly submitted request to delete personal data, NAVER Vietnam must respond within two (02) working days, provide the data subject with full information on the applicable procedure, and implement such actions within twenty (20) days. Where it is necessary to request the Data Processor or Third Party to provide, delete, or restrict processing of the data subject's personal data, this shall be implemented within thirty (30) days.
      Depending on the nature and complexity of the request, the processing period may be extended no more than once, by no more than twenty (20) days, with NAVER Vietnam notifying the data subject of the reason and bearing the burden of demonstrating that the extension is necessary and reasonable.
    5. Right to Complain, Denounce, Initiate Legal Proceedings, and Claim Damages: The Data Subject has the right to complain, denounce, initiate legal proceedings, and claim damages in accordance with applicable law.
    6. Right to Request Competent Authorities or NAVER Vietnam to Implement Protective Measures and Solutions for the Data Subject's Personal Data in Accordance with Applicable Law.
      Upon receipt of a duly submitted request to implement protective measures and solutions, NAVER Vietnam must respond within two (02) working days, provide the data subject with full information on the applicable procedure, and implement such measures within fifteen (15) days.
      Depending on the nature and complexity of the request, the processing period may be extended no more than once, by no more than fifteen (15) days, with NAVER Vietnam notifying the data subject of the reason and bearing the burden of demonstrating that the extension is necessary and reasonable.

    The Data Subject shall use the Form provided in this Personal Data Protection Policy of NAVER Vietnam to exercise their request rights.

  • 3.2. Data Subjects have the following obligations:
    1. Protect their own personal data;
    2. Respect and protect the personal data of others;
    3. Provide complete and accurate personal data as required by law, under contract, or when consenting to allow NAVER Vietnam to collect and process their personal data;
    4. Comply with the law on personal data protection and participate in preventing and combating violations related to personal data.

Article 4

Types of Personal Data Processed by NAVER Vietnam
  • 4.1. Basic personal data: Surname, middle name, and birth name; other names (if any); date, month, year of birth; gender; current residence and contact address; nationality; personal image; phone number, citizen identity card number, citizen identification document number, personal identification number, passport number, vehicle license plate number (in case the Data Subject parks their vehicle at NAVER Vietnam’s premises), individual tax identification number, social insurance book number; information about related persons of the Data Subject at NAVER Vietnam; other information associated with the Data Subject or helping identify the Data Subject, which does not fall within the Sensitive Personal Data specified in Clause 4.2 of this Article.
  • 4.2. Sensitive personal data processed by NAVER Vietnam includes: (a) biometric data (facial image) used for attendance and access control purposes; (b) images of citizen identity card, citizen identification document, and passport; (c) bank account number for salary payment; (d) login usernames and passwords for accessing NAVER Vietnam’s internal systems; (e) financial information including the Data Subject’s income and dependents’ income for recruitment process, personal income tax and social insurance purposes; (f) location data through positioning services related to working time; (g) data tracking behavior and usage of telecommunications and information systems within NAVER Vietnam; and (...) other sensitive personal data as may be processed by NAVER Vietnam from time to time, of which the Data Subject will be duly notified prior to processing in accordance with applicable law.

Article 5

Methods of Collecting Personal Data
NAVER Vietnam collects personal data as specified in Article 4 of this Policy from Data Subjects through activities including but not limited to:
  • • Directly through verbal and/or written exchanges and interactions between the Data Subject and NAVER Vietnam;
  • • From survey documents, social media, or from third parties providing service activities related to the Data Subject;
  • • From other third parties having a relationship with or associated with the Data Subject;
  • • Through files generated by NAVER Vietnam's official websites/platforms or other websites/platforms that NAVER Vietnam directs the Data Subject to access;
  • • Through other contracts/agreements signed between NAVER Vietnam and the Data Subject;
  • • Through CCTV surveillance footage stored by NAVER Vietnam.

Article 6

Duration of Personal Data Processing
  • 6.1. Start Time
  • NAVER Vietnam will commence processing the Data Subject's personal data from the time the personal data is received.
  • 6.2. End Time
  • NAVER Vietnam will cease processing the Data Subject's personal data upon (whichever occurs later):
  • - Receipt of a written request from the Data Subject in accordance with this Personal Data Protection Policy; NAVER Vietnam shall record and retain system logs of personal data processing activities for the purposes stated in section 2.4 of Article 2;
  • - Conclusion of a dispute or complaint via a legally effective agreement, judgment, or decision;
  • - Such other time as is appropriate to the Processing Purposes;
  • - As prescribed by law.
  • Notwithstanding the above, NAVER Vietnam may continue to retain personal data to fulfill its legal obligations, and NAVER Vietnam is responsible for maintaining the confidentiality of personal data as required by law and as consented to by the data subject.

Article 7

Storage and Security of Personal Data at NAVER Vietnam
  • 7.1. NAVER Vietnam commits to storing and securing the Data Subject's personal data safely and in compliance with applicable law. All third parties permitted to access, process, and store the Data Subject's personal data as provided under this Policy are required to comply with NAVER Vietnam's security obligations.
    • 7.1.1 Personal data shall be retained only for as long as is necessary to fulfil the processing purpose for which it was collected and notified to the Data Subject, unless a longer retention period is required or permitted by applicable law. Specifically:
      • (a) Personal data of employees and business partners related to employment contracts, accounting records, and tax documentation shall be retained for a minimum period of ten (10) years from the date of termination of the contractual relationship or completion of the relevant transaction, pursuant to the Law on Accounting No. 88/2015/QH13 and the Law on Tax Administration No. 38/2019/QH14.
      • (b) Personal data of unsuccessful recruitment candidates and competition participants shall be retained for a minimum period of five (05) years from the date on which the relevant recruitment process concludes.
      • (c) Operational data, including system access logs, CCTV footage, and system logs, shall be retained until the processing purpose ceases.
    • 7.1.2 Upon expiry of the applicable retention period set out in this Article, NAVER Vietnam shall delete or destroy the relevant personal data in accordance with the procedure set out in Article 2.5 of this Policy, unless continued retention is necessary to comply with a legal obligation or to establish, exercise, or defend legal claims.
  • 7.2. NAVER Vietnam applies appropriate data processing methods as well as adequate technical and organizational security measures to prevent unauthorized access, reading, use, modification, destruction, or other unauthorized processing of personal data.
  • 7.3. NAVER Vietnam shall record and retain system logs of personal data processing activities for the purposes stated in section 2.4 of Article 2 of this Policy and as required by law.
  • 7.4. The Data Subject acknowledges that NAVER Vietnam has applied, is applying, and/or will apply appropriate technical, physical, and administrative measures to protect and ensure the security of the Data Subject's personal data. However, these measures cannot fully guarantee the prevention of all unauthorized access by third parties such as hackers.
  • 7.5. Where the Data Subject’s personal data may be shared by NAVER Vietnam for the purposes stated in section 2.4 of Article 2 of this Policy, information security risks (such as the theft, leakage, or unauthorized access of the Data Subject’s personal data) may occur, as the internet is not a completely secure environment. NAVER Vietnam will stipulate in the data protection agreement or contract with the third party (Data Processor) that they must apply appropriate technical and organizational measures to protect personal data in accordance with the Law on Personal Data Protection. The Data Subject agrees to exempt NAVER Vietnam from liability as stipulated in Article 2.5(g).

Article 8

Amendment, Supplement, and Replacement of the Policy
  • 8.1. NAVER Vietnam is entitled to amend, supplement, or replace this Policy at any time it deems appropriate, ensuring that such amendments or supplements are consistent with applicable legal regulations.
  • 8.2. NAVER Vietnam will notify Data Subjects of any amendments, supplements, or replacements by one of the following means: written document, email, announcement via mass media, notice on NAVER Vietnam's official website, posting at the headquarters and transaction points of NAVER Vietnam, and/or any other means NAVER Vietnam deems appropriate.
  • 8.3. After 15 (fifteen) days from the date NAVER Vietnam applies the notification method referred to in Article 8.2 and notifies the Data Subject of any amendments, supplements, or replacements to this Policy, if NAVER Vietnam has not received any written or email response from the Data Subject, the Data Subject is deemed to have accepted all such amendments, supplements, or replacements in full.

Article 10

Dispute Resolution
In the event of any dispute arising out of or in connection with personal data processing, the Data Subject and NAVER Vietnam shall first seek to resolve the matter through negotiation and mediation. If mediation is unsuccessful, either party has the right to bring the dispute before a competent Court in Vietnam for resolution.

Article 11

Implementation Effect
This Personal Data Protection Policy takes effect with respect to the Data Subject from the time it is accepted/agreed upon (in any form) by the Data Subject.
